PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC -2008-10 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />JAMES HAPP/NORTHSTAR REALTY SERVICES, INC. AND <br />KENNETH AND PAMELA CHRISMAN FOR A MAJOR MODIFICATION, <br />AS FILED UNDER CASE PUD -81-28-05M <br />WHEREAS, the James Happ/Northstar Realty Services, Inc. and Kenneth and Pamela <br />Chrisman have applied for a major modification to an approved PUD <br />development plan to replace the approved production home designs with <br />design guidelines for the property located at 1944 Vineyard Avenue,in the <br />Vineyard Avenue Corridor Specific Plan Area; and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development — Low <br />Density Residential) District; and <br />WHEREAS, at its duly noticed public hearing of February 27, 2008, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, environmental review for the proposed project was undertaken with the <br />Final Environmental Impact Report (EIR) approved by the City Council for <br />the Vineyard Avenue Corridor Specific Plan in conformance with the <br />standards of the California Environmental Quality Act (CEQA); there are <br />no substantial changes to the project or to the circumstances under which <br />the project is being undertaken that involve new significant environmental <br />effects or that substantially increase the severity of previously identified <br />effects; furthermore, there is no new information of substantial importance <br />which was unknown at the time that the Final EIR was approved by the <br />City Council regarding the project or its effects, mitigation measures, or <br />alternatives; and any previously identified effects or impacts are mitigated <br />to a level of insignificance, with the mitigation measures incorporated into <br />the project's design or imposed on the project pursuant to the conditions <br />of approval; and <br />WHEREAS, the Planning Commission determined that the proposed modification <br />would be consistent with other recently approved projects" in the area. <br />
