THE CITY OF CITY COUNCIL AGENDA REPORT pLEASANTOK January 5, 2016 Community Development Department TITLE: PUD-25, GHC LUND RANCH, LLC — CONSIDER ADOPTION OF ORDINANCES APPROVING (1) A PLANNED UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT PLAN APPROVAL TO CONTRUCT 43 SINGLE-FAMILY, TWO-STORY HOMES AND RELATED IMPROVEMENTS ON THE APPROXIMATELY 194.7-ACRE LUND RANCH -- II PROPERTY LOCATED AT 1500 LUND RANCH ROAD AT THE END OF LUND RANCH ROAD, AND (2) A DEVELOPMENT AGREEMENT TO VEST ENTITLEMENTS FOR THE PROJECT; APPROVAL OF A RESOLUTION ADOPTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS AND THE MITIGATION MONITORING AND REPORTING PROGRAM; AND AUTHORIZATION FOR STAFF TO PROCESS THE PROJECT CONSISTENT WITH COUNCIL'S DECISION OF DECEMBER 15, 2015 SUMMARY On December 15, 2015, a majority of the City Council voted to reduce the number of home sites from 48 to 43, lower the building pad for Lot 32 to 500 feet, find that the northern ridgeline above Lot 32 ends at the 718-foot elevation, and mandate that access for 12 homes be through Lund Ranch Road and for 31 homes through Sunset Creek Lane. The documents before you effectuate the Council's direction of December 15, 2015. PLANNING COMMISSION RECOMMENDATION On August 26, 2015, the Planning Commission recommended approval of the project with 50 homes. RECOMMENDATION Consistent with Council majority's direction of December 15, 2015: 1. Waive the second reading and adopt Ordinance No. 2133 approving Case PUD-25, the PUD Rezoning and Development Plan, subject to the Conditions of Approval listed in Exhibit A; 2. Waive the second reading and adopt Ordinance No. 2134 approving the Development Agreement to vest entitlements to the project; 3. Adopt by resolution the revised CEQA Findings and the Mitigation and Monitoring and Reporting Program; and 4. Authorize staff to take appropriate steps to effectuate Council's intent consistent with the above approvals.
