BACKGROUND <br /> On December 1, 2015, a majority of the City Council approved the project with <br /> 48 homes, waived the first reading and introduced ordinances approving the PUD <br /> Rezoning and Development Plan and the Development Agreement, certified the EIR, <br /> and approved the Affordable Housing Agreement and Growth Management Agreement. <br /> On December 15, 2015, while considering waiving the second reading and adoption of <br /> . the ordinances approving the PUD Rezoning and Development Plan and the <br /> Development Agreement, a majority of the City Council approved the project with <br /> 43 homes and additional conditions. The effect of that latter action was to introduce the <br /> two ordinances as modified by the City Council on December 15, 2015, with final <br /> adoption to occur at the adjourned regular meeting of January 5, 2016. <br /> DISCUSSION <br /> The City Council majority's action to reduce the number of units from 48 to 43 requires, <br /> pursuant to Government Code section 36934, that the two ordinances, as revised by <br /> City Council's direction on December 15, 2015, be considered as being introduced at <br /> that December 15, 2015 meeting. At the adjourned regular meeting of January 5, 2016, <br /> the Council is considering the two ordinances for final adoption. <br /> The draft ordinances and related documents before the City Council on January 5, 2015 <br /> show, in underline and strikeout text, the modifications verbally expressed by the City <br /> Council on December 15, 2015. (Final ordinances and documents, if adopted, will <br /> incorporate all the changes shown, and will no longer appear in underline and strikeout <br /> text.) <br /> The ordinance approving the PUD Rezoning and Development Plan now reflects <br /> 43 units, eliminates Lots 34-38 as shown on the Preliminary Grading and Utility Plan, <br /> Lund Ranch II (forwarded to the City Council via memo on November 30, 2015, and <br /> discussed at the December 1, 2015 Council meeting), reduces the elevation of Lot 32 to <br /> 500 feet or less, sets the ridgeline above Lot 32 at elevation 718 feet, and mandates <br /> that access for 12 homes be through Lund Ranch Road and access for 31 homes be <br /> through Sunset Creek Lane. The Conditions of Approval have been modified consistent <br /> with this direction, including a revised site plan provided as Exhibit A-1 in Attachment 1. <br /> The ordinance approving the Development Agreement, and the Development <br /> Agreement itself, have been modified to reflect the Council's December 15, 2015 <br /> revisions to the project. <br /> • The CEQA Findings and the Mitigation Monitoring and Reporting Program have been <br /> modified to reflect the Council's December 15, 2015 revisions to the project. Therefore, <br /> it is appropriate to adopt a resolution adopting these documents. <br /> On December 1, 2015, the City Council approved an Affordable Housing Agreement <br /> and a Growth Management Agreement, with the caveat that the City Attorney shall <br /> approve the final form of the documents.
