THE CITY OF =`y CITY COUNCIL AGENDA REPORT 2 pLEASANTONC August 20, 2013 City Attorney TITLE: ADDITIONAL TWO MONTH EXTENSION OF AGREEMENT PROVIDING FOR RENT STABILIZATION OF MOBILEHOME SPACE RENTS FOR THE HACIENDA MOBILEHOME PARK SUMMARY The City has had mobilehome rent stabilization agreements for three of its four mobilehome parks since 1988. Such agreements exempt a park owner from regulation under the City's mobilehome space rents ordinance set forth in Chapter 6.60 of the Municipal Code. The existing 2007 agreement with the owner of the Hacienda Mobilehome Park was to expire December 31, 2012. The City Manager approved a two month extension of that agreement on December 26, 2012 and the City Council ratified that extension on January 15, 2013. The City Manager approved an additional one month extension of that agreement on February 27, 2013 and the City Council ratified that extension on March 5, 2013. A third extension was entered into on March 31, 2013 and ratified by the City Council on April16, 2013. A fourth extension was entered into on May 2, 2013 and ratified by the City Council on May 7, 2013. A fifth extension was entered into May 31, 2013 and ratified by the City Council on June 4, 2013. Staff continues to work with the owner of that park and its residents to iegotiate a new agreement, but an agreement has not yet been reached. An additional two month extension of the agreement is reasonable as it can allow the parties to continue to move toward a resolution of the issues before them. The park owner has agreed to such an extension, and the Hacienda Mobilehome Park Resident's Agreement Committee has indicated its approval. On July 31, 2013, the City Manager signed a Sixth Amendment to Agreement Providing for Stabilization of Mobilehome Space Rents between the City and the owner of the Hacienda Mobilehome Park. City Council action is now requested to ratify the City Manager's signature on that Sixth Amendment to Agreement Providing for Stabilization of Mobilehome Space Rents in Hacienda Mobilehome Park. RECOMMENDATION Ratify the City Manager's action of July 31, 2013 to sign the Sixth Amendment to Agreement Providing for Stabilization of Mobilehome Space Rents between the City and the owner of the Hacienda Mobilehome Park. FINANCIAL STATEMENT There is no financial impact to the City. Residents of Hacienda Mobilehome Park will pay the same rent as they did in January, February, March, April, May, June and July 2013.
