THE CITY OF 13 <br /> WI- CITY COUNCIL AGENDA REPORT <br /> PLE ASANTON. <br /> June 18, 2013 <br /> Assistant City Manager <br /> TITLE: APPROVAL OF THE FIRST AMENDMENT TO THE DESIGN <br /> PROFESSIONAL SERVICES AGREEMENT WITH HARRIS DESIGN <br /> FOR THE BERNAL COMMUNITY PARK, PHASE II <br /> SUMMARY <br /> In October 2008, the City entered into an agreement with Harris Design to provide <br /> design services for the Bernal Community Park Phase II. However, shortly after <br /> beginning the project, the City suspended work on the entire park project pending an <br /> improved economy and preparation of a park development and construction financing <br /> plan. To that end, on September 12, 2012, the City Council adopted the preliminary <br /> park financing plan, approved the Draft Schematic Plan for Phase II of Bernal <br /> Community Park, and authorized Harris Design to restart its park design services and <br /> begin preparation of the park's construction bid documents. Since September 2012, <br /> staff has been working with Harris Design on refining the overall park design plan and <br /> identifying cost saving options that has resulted in the park being included in the 2013- <br /> 14 through 2016-2017 Capital Improvement Program. Based on the cost reductions <br /> developed through the park refinement process, staff has identified adequate funding to <br /> allow for the full design and construction of both the park and the Oak Woodland area <br /> that is immediately adjacent to the park. Due to the adjacency with Bernal Community <br /> Park and the work already included in Harris Design's agreement related to portions of <br /> the Oak Woodland area, staff requested Harris Design provide a proposal for expanding <br /> its current scope of work to include the entire Oak Woodland area arid to amend the <br /> current fee schedule to reflect the refined park plan. The result of that process is <br /> included in the First Amendment to the Design Professional Services Agreement for the <br /> Bernal Community Park Phase II. <br /> RECOMMENDATION <br /> Approve the attached First Amendment to the Professional Design Services Agreement <br /> for the Bernal Community Park Phase II with Harris Design for a cost not to exceed <br /> $127,771 plus a 5% contingency of $6,400 for a total contract value of $134,171. <br /> FINANCIAL IMPACT <br /> Fees related to the First Amendment will be paid from the Bernal Community Park, <br /> Phase II Lighted Multi-Purpose Sports Fields project included in the City's Capital <br /> Improvement Program (CIP 017045). <br />
