THE CITY OF 10 moo -- # -- 111 CITY COUNCIL AGENDA REPORT PL EASANTONo April 2, 2013 Community Development Planning Division TITLE: P12-1796, CITY OF PLEASANTON — CONSIDER THE DRAFT ORDINANCE AMENDING TITLE 18 OF THE PLEASANTON MUNICIPAL CODE TO ADD CHAPTER 18.70, RIDGELINE AND HILLSIDE PROTECTION AND PRESERVATION, TO COMPLY WITH THE PROVISIONS OF MEASURE PP AND THE PLEASANTON GENERAL PLAN RELATED TO THE RIDGELINE AND HILLSIDE AREAS OF THE CITY SUMMARY The proposed ordinance would amend Title 18 of the Pleasanton Municipal Code to add Chapter 18.70, Ridgeline and Hillside Protection and Preservation, to regulate ridgeline and hillside development in compliance with Measure PP, adopted by Pleasanton voters in November 2008. The proposed Chapter incorporates the comments and directions made by the City Council at its special meeting on the implementation of Measure PP, that were then refined through the public hearing process before the Planning Commission. The Planning Commission (5-0 vote) forwarded the proposed Chapter to the City Council with recommendations to apply the ridgeline setback to the top of structures rather than the pad elevation, to define streets as structures which will prohibit streets from the hillside areas regulated by Measure PP (even if anticipated by a previous Specific Plan), and to recommend that the City Council consider creating an inventory of the City's ridgelines for incorporation into the proposed Code Chapter. PLANNING COMMISSION ACTION Recommend approval of Chapter 18.70 with modifications. RECOMMENDATION 1. Find that the proposed amendment to Title 18 is categorically exempt from environmental review pursuant to California Environmental Quality Act Guidelines, Section 15308, Actions by Regulatory Agencies for Protection of the Environment; 2. Introduce the draft ordinance approving P12-1796 to amend Title 18 of the Pleasanton Municipal Code to add Chapter 18.70, Ridgeline and Hillside Protection and Preservation, subject to Exhibit A (Attachment #1). FINANCIAL STATEMENT Implementing the proposed Code Chapter would have a negligible financial impact on the City.
