THE CITY OF 9 <br /> CITY COUNCIL AGENDA REPORT OVA <br /> pLETASANTONo <br /> March 19, 2013 <br /> Community Development <br /> Engineering Division <br /> TITLE: ACCEPT IMPROVEMENTS AND EASEMENT FROM ALANIEDA COUNTY <br /> FLOOD CONTROL AND WATER CONSERVATION DISTRICT, ZONE 7, <br /> FOR DRAIN IMPROVEMENTS IN THE VICINITY OF THE BERNAL <br /> AVENUE UNDERCROSSING AT THE UNION PACIFIC RAIL.ROAD (UPRR) <br /> SUMMARY <br /> Shortly after the City acquired the Bernal property in 2002, it began restoring the Bernal <br /> Creek to a more natural functioning ecosystem. The creek is now fully restored and <br /> continues to function as part of the City's storm drain system. Recently, the Alameda <br /> County Flood Control and Water Conservation District, Zone 7 (Zone 7) approached the <br /> City about taking over ownership and maintenance of an existing storm drain pipe that <br /> runs between Bernal Court and the Bemal Creek. City staff inspected the pipe, found it <br /> to be in very good condition and determined that due to its location between two City- <br /> maintained storm drain lines, it is practical for the City to assume ownership and <br /> responsibility for the pipe. Staff is recommending approval of a quitclaim of easement <br /> that will transfer ownership of this storm drain line from Zone 7 to the City. The location <br /> of the pipe is shown on Attachment 1. <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to accept and record the quitclaim of easement from <br /> Alameda County Flood Control and Water Conservation District, Zone 7. <br /> 2. Accept for normal maintenance the Zone 7 storm drain improvements. <br /> FINANCIAL STATEMENT <br /> Assuming responsibility for the Zone 7 storm drain will not result in any measurable <br /> increases to the cost of operating and maintaining the existing storm drain system. <br />
