BACKGROUND <br /> Since the City acquired ownership of the Bernal Creek, Zone 7 has been reviewing its <br /> maintenance responsibilities around the Bernal Property. Recently, Zone 7 staff <br /> identified that a portion of its storm drain system is located between the Bernal Creek <br /> and the City's storm drain system located on Bernal Court (Attachment 1). While a <br /> portion of this storm drain was relocated by the City in the 1980s as part of the Bernal <br /> Avenue undercrossing at the Union Pacific Railroad (UPRR), Zone 7 continued to own <br /> and maintain this segment because it owned and maintained the downstream creek <br /> (now called the Bernal Creek) that ran through the Bernal Property. Now that the City <br /> has taken ownership of the Bernal Creek, Zone 7 is requesting that the City assume <br /> responsibility and ownership of this storm line segment. <br /> DISCUSSION <br /> Staff has reviewed Zone 7's request and determined that it makes sense for the City to <br /> maintain this portion of the storm drain line since the City owns the storm drain system <br /> both "upstream" and "downstream" of the Zone 7 portion. City maintenance crews have <br /> inspected the line with the use of a video camera and found it to be in very good <br /> condition. Staff is therefore recommending acceptance of the ownership and <br /> maintenance of this section of storm drain pipe and associated manholes. <br /> The attached quitclaim of the easement from Zone 7 is typical of previous transfers <br /> between the City and Zone 7 and consistent with City requirements. As mentioned, a <br /> portion of this storm drain system was relocated with the Bernal Avenue Undercrossing <br /> project and is already located within the Bernal Avenue right of way so no adjustments <br /> are needed in the quitclaim of the easement for this portion of the storm drain system. <br /> Submitted by: Approved <br /> Brian Dolan Nelson Fialho <br /> Director of Community City Manager <br /> Development <br /> Attachments: <br /> 1.
