Q9, - /Coq <br /> MAINTENANCE AGREEMENT <br /> By and Between <br /> CITY OF LIVERMORE AND CITY OF PLEASANTON <br /> (EL CHARRO ROAD INFRASTRUCTURE) <br /> This MAINTENANCEAGREEMENT ("Agreement") is made and entered into this <br /> 00 day of roucial Vain , 2012 by and between the City of Pleasanton("Pleasanton") <br /> and the City of Livermore("Livermore"). <br /> RECITALS <br /> WHEREAS, Livermore has completed the construction of public improvements to <br /> support its El Charro Specific Plan Area and the Pleasanton Stoneridge Drive Specific Plan, <br /> Amendment Staples Ranch. Such public improvements include: widening of El Charro Road <br /> from I-580 to the proposed extension of West Jack London Blvd.; extending West Jack London <br /> Blvd. to El Charro Road; improvements to the El Charro/Fallon Rd. Interchange; flood control <br /> improvements including conveyance basin and culverts; water quality basins; storm drain, sewer, <br /> water and recycled water system improvements; sewer pump station; utility extensions and joint <br /> trench; landscaping and irrigation; bike and pedestrian trail connection; and traffic signals and <br /> lighting(collectively the "Improvements"). <br /> WHEREAS, Livermore, Pleasanton, the County of Alameda, the Surplus Property <br /> Authority of the County of Alameda(the Authority), Calmat Co., d.b.a. Vulcan Materials, <br /> Western Division, have entered into that Pre-Development and Cooperation Agreement dated <br /> September 18, 2007 (the "Cooperation Agreement") addressing many issues related to the El <br /> Charro Specific Plan Area in Livermore and the Stoneridge Drive Specific Plan, Amendment <br /> Staples Ranch. <br /> WHEREAS, portions of the Improvements owned by each city will be located outside of <br /> its city limits. <br /> WHEREAS, Livermore and Pleasanton desire to clarify maintenance responsibilities for <br /> the Improvements. <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br /> Agreement, the parties agree as follows: <br /> 1. El Charro Road Improvements. The El Charro Road Improvements are <br /> described more particularly as: El Charro Road from I-580 to just south of West Jack London <br /> Blvd. within Pleasanton's City limits, including sidewalks, medians, and landscaping; storm <br /> drain system, including storm culverts, manholes and catch basins within El Charro Road; the <br /> storm drain system with outlet into the hydromodification basin to the east of El Charro Road; <br /> utility extensions (water, and recycled water) and joint trench within El Charro Road; <br /> El Charro Maintenance Agreement/Livermore/Pleasanton Page 1 of 4 <br />
