landscaping and irrigation systems within the median of El Charro Road, including associated <br /> metering for electrical energy costs and water usage; traffic signals at the intersection of El <br /> Charro Road/ Stoneridge Drive/West Jack London Blvd., and street lighting along El Charro <br /> Road. The El Charro Road Improvements are shown on the improvement plans entitled <br /> "Improvement Plans of El Charro Specific Plan Infrastructure Project Phase 1 for City of <br /> Livermore, City Project No. 2007-20"prepared by Kier and Wright Civil Engineers, dated April <br /> 26, 2011, and on file in the office of the Livermore City Engineer (hereinafter"Improvement <br /> Plans"). <br /> 2. Pleasanton Maintenance Items. Pleasanton will maintain the El Charro Road <br /> Improvements located within its city limits, which is generally defined at the back of curb on <br /> the easterly side of El Charro Road and the traffic signal at El Charro Road and Stoneridge <br /> Drive/West Jack London Blvd., Maintenance will include portions of the Improvements, <br /> including loop detectors, street lights and pull boxes serving El Charro Road that are physically <br /> located within Livermore. Pleasanton is to maintain the recycled water system from West Jack <br /> London Boulevard that enters El Charro Road from the valve immediately west of the City of <br /> Livermore's recycled water turnout at Station 3+42. Pleasanton also agrees to maintain the <br /> potable water system from West Jack London Boulevard, entering El Charro Road as agreed <br /> upon in the Emergency Potable Water Services Agreement between the City of Pleasanton and <br /> City of Livermore executed on October 27, 2011. <br /> 3. Livermore Maintenance Items. Livermore will maintain those improvements <br /> located within its city limits, which is generally defined as back of curb east of El Charro Road. <br /> Maintenance will include the storm water lateral east of the manhole at station 29 + 36.75 <br /> extending east into West Jack London Blvd., the storm drain main line south of the manhole at <br /> 29 + 36.75 extending south to the manhole at station 22 + 69.00 and the storm water lateral east <br /> of the manhole at station 22 + 69.00 extending east to the hydromodification basin which are <br /> located within Pleasanton. (Shown generally on the attached Exhibit A.). Livermore agrees to <br /> maintain the new 18"recycled water line in West Jack London Boulevard up to and including <br /> the valve immediately west of the City of Livermore's recycled water turnout at Station 3 + 42. <br /> Livermore will maintain the potable water system in West Jack London Boulevard as agreed <br /> upon in the Emergency Potable Water Services Agreement between the City of Pleasanton and <br /> City of Livermore executed on October 27, 2011. <br /> 4. Pleasanton Maintenance Timing. Maintenance set forth in Sections 2 and 3 above, <br /> shall commence at the time the El Charro Road Improvements are certified for substantial <br /> completion by the City Engineers of both Livermore and Pleasanton. If any defects come to the <br /> attention of Pleasanton during the one-year maintenance period following the date of substantial <br /> completion of the El Charro Road Improvements ,Pleasanton shall promptly advise Livermore <br /> of such defects, and Livermore and Pleasanton shall discuss whether to seek repair of such defect <br /> by the general contractor. After the one-year maintenance period following the date substantial <br /> completion of the El Charro Road Improvements, Pleasanton shall be responsible for any <br /> repairs to the El Charro Road Improvements. <br /> El Charro Maintenance Agreement/Livermore/Pleasanton Page 2 of 4 <br />
