AGREEMENT <br /> FOR <br /> EMERGENCY POTABLE WATER SERVICES BETWEEN THE CITY OF PLEASANTON <br /> AND <br /> THE CITY OF LIVERMORE <br /> THIS AGREEMENT, made and entered into this 9 day of O i?A V Q-r <br /> by and between the CITY OF PLEASANTON, a municipal corporation in the State of <br /> California and the CITY OF LIVERMORE, a municipal corporation in the State of California; <br /> WITNESSETH : <br /> WHEREAS, the City of Pleasanton and the City of Livermore are responsible for <br /> providing potable water at all times to customers within their respective service areas; and <br /> WHEREAS, the City of Pleasanton and the City of Livermore have adjoining service <br /> areas; and <br /> WHEREAS, in the event of an emergency in either agency, it may become desirable for <br /> one agency to supply potable water temporarily to the other agency for the duration of the <br /> emergency; and <br /> WHEREAS, this agreement pertains solely to the provision of water during emergency <br /> conditions and shall not be construed to provide supplemental or other water services or sales. <br /> NOW, THEREFORE, in consideration of the mutual covenants and agreements <br /> hereinafter set forth, the parties hereto agree as follows: <br /> 1. DEFINITION OF EMERGENCY.
