event beyond the control of either agency which causes the demand for water to exceed the <br /> system capacity of either agency. Emergency also means a short term shutdown in deliveries <br /> from Zone 7 due to construction or maintenance of Zone 7 facilities by Zone 7. Emergency does <br /> not mean a shortage of water due to high continuing demand or drought, and an intertie <br /> connection shall not be used as a standby or reserve source of water to meet the peak water <br /> requirements of either agency. <br /> 2. DECLARATION OF EMERGENCY. Either agency, upon its determination that <br /> an emergency exists within its service area, may request service under this Agreement and the <br /> other agency immediately shall respond with its determination regarding the existence of such <br /> emergency and, if there is concurrence, whether potable water is available. Communication of <br /> requests between the agencies under this paragraph 2 shall be made by the City Manager of the <br /> City of Pleasanton and the City Manager of the City of Livermore or their designated <br /> representatives. <br /> 3. SCOPE OF WATER SUPPLY SERVICE. Each agency shall provide and maintain <br /> all piping, valves, connections and appurtenances to common interconnecting point as described <br /> below for the purpose of connecting the two systems. Each agency shall maintain any and all <br /> pumps, valves, control devices and meter that it requires for interconnection to control the <br /> volumes and pressures of potable water transferred between the agencies' systems. <br /> The supplying agency shall furnish to the receiving agency the quantities of treated <br /> water which the latter shall reasonably require during the emergency, the supply shall be <br /> interruptible subject to the determination of the supplying agency that the water is available <br /> under the circumstances then prevailing in its service area.
