PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2002-17 <br />RESOLUTION RECOMMENDING APPROVAL OF SOUTH BAY CONSTRUCTION <br />FOR A MODIFICATION TO AN APPROVED PUD DEVELOPMENT PLAN, AS <br />FILED UNDER CASE PUD-02-2M <br />WHEREAS, South Bay Construction has applied for a modification to an approved PUD <br />development plan (PUD-02) -the approved PUD Development Plan for eight office <br />buildings comprising of 745,000-square feet of floor azea and related facilities <br />located at the southwest corner of Bernal Avenue and the extension of Valley <br />Avenue - to delete the two-year construction timing condition (Condition No. 2, of <br />the "Conditions of Approval for the Office Development Plan," Ordinance 1814), <br />thereby extending the development plan approval for the same time period as the <br />vesting time period of the "Development Agreement" for the "Bernal Property <br />PUD," which expires on August 21, 2010; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C/O <br />(CommerciaUOffice) District; and <br />WHEREAS, at its duly noticed public hearing of February 27, 2002, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, the proposed modification is considered a minor land use modification and, <br />therefore, is exempt from the requirements of the California Envirorunental <br />Quality Act (CEQA); and <br />WHEREAS, the Planning Commission determined that the proposed modification to the <br />previously approved PUD Development Plan is consistent with the Bernal <br />Avenue Specific Plan and the City of Pleasanton General Plan; and <br />WHEREAS, the Planning Commission determined that the proposed PUD modification, as <br />conditioned, is appropriate. <br />
