City of Pleasanton <br /> East Bay Regional Park District <br /> PLEASANTON RIDGE /AUGUSTIN BERNAL PARK <br /> OPERATING AGREEMENT <br /> THIS AGREEMENT is made this 7th day of November , 1989 , between <br /> the City of Pleasanton, a municipal corporation (hereafter "City ") and the East Bay <br /> Regional Park District, a body corporate and politic (hereafter "District "). <br /> RECITALS <br /> WHEREAS, CITY and DISTRICT own and hold contiguous parklands of a similar <br /> nature on Pleasanton Ridge ( "Ridge ") for the purpose of operating and maintaining park <br /> and open space lands for public use; and <br /> WHEREAS, CITY and DISTRICT and the public will realize benefit from the CITY <br /> and DISTRICT cooperating in the operation and the sharing of certain services that are <br /> necessary for safe park operation. <br /> NOW, THEREFORE, in consideration of the mutual promises expressed herein, the <br /> parties agree as follows: <br /> 1. PUBLIC ACCESS <br /> A. Members of the public may access the Ridge at specified locations on <br /> the contiguous boundaries of CITY and DISTRICT parklands and may <br /> travel on designated trails on lands belonging to each agency. The <br /> locations for designated trail access are set forth on Exhibit "A" <br /> attached to this Agreement. This section is not intended to affect any <br /> limitations that either agency has with respect to its separate public <br /> entrances to the Ridge. <br /> B. Nothing in this section or Agreement is intended to permit vehicular <br /> access by the public to the upper areas of the Ridge. Because <br /> significant restrictions concerning vehicular access apply to CITY - <br /> owned property along the Ridge, DISTRICT shall discuss with CITY <br /> any of the DISTRICT's plans to permit public vehicular access to its <br /> ridgetop property prior to permitting same. <br /> C. The public will be subject to the rules and regulations which each <br /> agency enforces on its own property. Each agency will inform the other <br /> of changes to park rules in advance and discuss possible modifications <br /> of park rules to reduce confusion for park users and to facilitate <br /> enforcement. <br /> 1 <br />
