THE CITY OF - r <br /> s; °" • -'-� "" CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON. <br /> September 7, 2010 <br /> City Manager <br /> TITLE: RATIFY AMENDMENTS TO THE PROFESSIONAL SERVICES <br /> AGREEMENTS WITH MACKAY AND SOMPS; ELS ARCHITECTURE <br /> AND URBAN DESIGN AND O'CONNOR CONSTRUCTION <br /> MANAGEMENT INC.; RATIFY CHANGE TO THE FIREHOUSE ARTS <br /> CENTER CONSTRUCTION CONTRACT (CIP NO. 038011) WITH W.A. <br /> THOMAS COMPANY, INC.; RATIFY PLANS, SPECIFICATIONS AND <br /> PROJECT BUDGET FOR THE FIREHOUSE ARTS CENTER PARKING <br /> LOT, PLAZA AND GARDEN AREAS (CIP NO. 098035) <br /> SUMMARY <br /> In June 2008, the City Council authorized acquisition of the Downtown Transportation <br /> Corridor (Corridor) from Alameda County to accommodate improvements, including <br /> parking, for the Firehouse Arts Center (Arts Center) as well as provide an interim <br /> staging area for the storage of materials, equipment and surplus soil related to the <br /> construction of the Arts Center. As completion of the construction within the corridor <br /> had to be coordinated closely with the scheduled completion of the Arts Center, the City <br /> entered into a professional services agreement with the firm of MacKay and Somps to <br /> design the parking lot, plaza and garden areas for the Arts Center. To expedite this <br /> work in the most cost effective manner and ensure coordination, a construction change <br /> order was negotiated with W. A. Thomas Company, Inc. (WATCO) for the construction <br /> of the parking lot, plaza and garden areas. In addition, staff has negotiated <br /> amendments to the professional services agreements with O'Connor Construction <br /> Management Inc. and ELS Architecture and Urban Design for construction <br /> management services and additional construction administration support for the Arts <br /> Center, parking lot, plaza and garden areas. <br /> RECOMMENDATION <br /> 1. Ratify amendments to the following existing agreements: <br /> • Amendments No. 1 and 2 to the professional services agreement with MacKay <br /> and Somps in the amounts of $50,080 and $144,924 (for a total of $195,004) <br /> for the design services and preparation of construction documents for the plaza <br /> and garden areas between the Arts Center and Lions Wayside Park, and to <br /> provide construction administration services for the parking lot, plaza and <br /> garden areas; <br /> • Amendment No. 1 to the professional services agreement with O'Connor <br /> Construction Management Inc. in the amount of $79,115 to provide ongoing <br /> construction management services of the Firehouse Arts Center, including <br /> support services for the facility's theatrical equipment and other building <br />
