RESOLUTION NO. 10 -340 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, <br /> CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL <br /> ELECTION TO BE HELD ON TUESDAY, JUNE 8, 2010 WITH THE STATEWIDE DIRECT <br /> PRIMARY ELECTION TO SUBMIT TO THE VOTERS THE REFERENDUM PETITION FOR <br /> ORDINANCE NO. 1961 REGARDING THE OAK GROVE DEVELOPMENT PLAN <br /> WHEREAS, under the laws relating to general law cities in California a General <br /> Municipal Election shall be held on Tuesday, June 8, 2010 to submit to the voters the <br /> Referendum Petition for Ordinance No. 1961 regarding the Oak Grove Development Plan; and <br /> WHEREAS, Elections Code §9282 specifies that the legislative body, or any member or <br /> members of the legislative body authorized by that body, may file a written argument for or <br /> against any City measure; and <br /> WHEREAS, Elections Code §9285 sets forth the procedures for rebuttal arguments; and <br /> WHEREAS, Elections Code §9280 specifies that the City Council may direct the City <br /> Clerk to transmit a copy of the measure to the City Attorney to prepare an impartial analysis <br /> thereof. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br /> Section 1. That pursuant to the laws of the State of California relating to general law <br /> cities the City Council does submit to the voters a ballot measure at a General Municipal <br /> Election on June 8, 2010. <br /> Section 2. That the following question be submitted to the voters at said election: <br /> Shall the Development Plan for the Oak Grove property be approved? YES <br /> NO <br /> (As to this section, motion carried unanimously.) <br /> Section 3. That the complete text of the measure submitted to the voters is as set <br /> forth in the attached Exhibit A. <br /> Section 4. The City Clerk is directed to transmit the measure to the City Attorney to <br /> prepare an impartial analysis of the measure by Friday, February 26, 2010. <br /> (As to this section, motion carried unanimously.) <br /> Section 5. Except as provided otherwise in this resolution, the Council adopts the <br /> procedures set forth in Elections Code §9285 regarding submission of rebuttal arguments. <br /> (As to this section, motion carried unanimously.) <br /> Section 6. Monday, March 15, 2010 and Thursday, March 25, 2010, respectively, <br /> are established as the deadlines for submission of direct and rebuttal arguments for the <br /> measure. Arguments shall be filed with the City Clerk by 5:00 p.m. on the respective deadline <br /> date, signed, with the printed name(s) and signature(s) of the author(s) submitting it, or if <br /> submitted on behalf of an organization, the name of the organization, and the printed name and <br /> signature of at least one of its principal officers who is the author of the argument.
