RESOLUTION NO. 10 -340 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE 8, 2010 WITH THE STATEWIDE DIRECT PRIMARY ELECTION TO SUBMIT TO THE VOTERS THE REFERENDUM PETITION FOR ORDINANCE NO. 1961 REGARDING THE OAK GROVE DEVELOPMENT PLAN WHEREAS, under the laws relating to general law cities in California a General Municipal Election shall be held on Tuesday, June 8, 2010 to submit to the voters the Referendum Petition for Ordinance No. 1961 regarding the Oak Grove Development Plan; and WHEREAS, Elections Code §9282 specifies that the legislative body, or any member or members of the legislative body authorized by that body, may file a written argument for or against any City measure; and WHEREAS, Elections Code §9285 sets forth the procedures for rebuttal arguments; and WHEREAS, Elections Code §9280 specifies that the City Council may direct the City Clerk to transmit a copy of the measure to the City Attorney to prepare an impartial analysis thereof. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That pursuant to the laws of the State of California relating to general law cities the City Council does submit to the voters a ballot measure at a General Municipal Election on June 8, 2010. Section 2. That the following question be submitted to the voters at said election: Shall the Development Plan for the Oak Grove property be approved? YES NO (As to this section, motion carried unanimously.) Section 3. That the complete text of the measure submitted to the voters is as set forth in the attached Exhibit A. Section 4. The City Clerk is directed to transmit the measure to the City Attorney to prepare an impartial analysis of the measure by Friday, February 26, 2010. (As to this section, motion carried unanimously.) Section 5. Except as provided otherwise in this resolution, the Council adopts the procedures set forth in Elections Code §9285 regarding submission of rebuttal arguments. (As to this section, motion carried unanimously.) Section 6. Monday, March 15, 2010 and Thursday, March 25, 2010, respectively, are established as the deadlines for submission of direct and rebuttal arguments for the measure. Arguments shall be filed with the City Clerk by 5:00 p.m. on the respective deadline date, signed, with the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers who is the author of the argument. The
