THE CITY OF <br /> 7 <br /> pL£ASNTONC <br /> MEMORANDUM <br /> Date: January 28, 2010 <br /> To: Honorable Mayor and Member of th City Council <br /> From: Nelson Fialho, City Manager <br /> Brian Dolan, Community Development Director w <br /> Subject: Case PAP -139 (PCUP -257), Mari Kennard, Redcoats <br /> Staff would like to supplement the recommended conditions of approval for this application based on <br /> additional discussion with affected nearby business and property owners. Staff recommends that the <br /> following conditions be added: <br /> 10. The business owner shall adhere to a "good neighbor" policy, meaning that the operator and <br /> employees must respect the rights of neighboring properties and, to the best of their ability, shall <br /> ensure their patrons' compliance with the City's noise and smoking regulations and any applicable <br /> conditions of approval for the subject business relating to parking location, smoking location, litter, <br /> noise, loitering, etc. <br /> 11. The business owner shall implement a nightly closing procedure each evening indoor music occurs <br /> that shall include the following: <br /> a. If approved by the relevant neighboring property owners, the operator shall perform an <br /> inspection with flashlight of the City street, sidewalks, entranceways, and landscaping in front of <br /> the surrounding properties for litter (including cigarettes), beverage containers (cans, bottles, <br /> glassware, etc.), vomit, and other items that were likely to have been left there by Redcoats <br /> patrons. <br /> b. The applicant (or designated representative) shall immediately clean up any litter (including <br /> cigarettes), beverage containers (cans, bottles, glassware, etc.), vomit, and other items that were <br /> likely to have been left by Redcoats patrons found on the City street, sidewalks, entranceways, <br /> and landscaping in front of the surrounding properties. <br /> For the purposes of this condition, the surrounding properties shall include: the south side of St. <br /> Mary Street between the eastern property line of 348 St. Mary Street (currently occupied by <br /> Fernando's Restaurant) and the eastern edge of the 312 St. Mary Street building (currently occupied <br /> by Al's Hair Design and Gene and Genie Finch); and the north side of St. Mary Street between the <br /> western property line of 351 St. Mary Street (currently occupied by Harris Real Estate Service, Inc. <br /> and Harris, Rosales, and Harris Attorneys at Law) and the eastern edge of the building at 327 St. <br /> Mary Street (currently occupied by Mike Carey Real Estate). <br />
