PC-2001-14

RESOLUTION APPROVING THE APPLICATION OF TRI-CITY BAPTIST
CHURCH FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED
UNDER CASE UP-99-48

WHEREAS,

Tri-City Baptist Church has applied for a conditional use permit to allow
the operation of an existing private school for up to 50 students at the
existing Evangelical Free Church located at 6900 Valley Trails Drive; and

WHEREAS, zoning for the property is R-1-6,500 District; and

WHEREAS,

at its duly noticed public hearing of March 14, 2001, the Planning
Commission considered all public testimony, relevant exhibits, and
recommendations of the City staff concerning this application; and

WHEREAS, projects of this nature are categorically exempt from the requirements of
the California Environmental Quality Act (CEQA); and

WHEREAS, the Planning Commission made the following findings:

The proposed location of the conditional use is in accordance with
the objectives of the zoning ordinance and the purpose of the
district in which the site is located.

The proposed use requires relatively simple physical facilities in
which to operate. The church classrooms can provide an
appropriate environment in which such an instruction-oriented use
would be compatible with adjacent residential uses and consistent
with the objectives of the residential zoning district in which it is
located.

The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety, or welfare, or materially
injurious to the properties or improvements in the vicinity.

The proposed use will provide facilities in conformance with local
and state regulations. Sufficient parking, maintenance of noise
levels, and safety and security within the premises have been
provided. All streets around the site are designed per City
standards to provide safe ingress and egress into and out of the site.
