CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1512 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> SPIEKER PARTNERS FOR A MAJOR MODIFICATION TO <br /> /&NAPPROVED PLANNED UNIT DEVELOPMENTAS FILED <br /> UNDER CASE PUD-89-6-3M <br /> <br />WHEREAS, Spieker Partners has applied for a major modification to <br /> an approved planned unit development (PUD-89-6) for Rose <br /> Pavilion (Phase III), located at the northwest corner of <br /> the intersection of Santa Rita Road and Rosewood Drive, <br /> to permit banners, pennants and other non-reflective <br /> decorations in conjunction with grand openings and <br /> special events if found to be in conformance with the <br /> City's provisions for temporary conditional use permits; <br /> and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br /> - Commercial District; and <br /> <br />WHEREAS, the PUD for the Rose Pavilion ShoppiD4Center (Phase III) <br /> was approved in June, 1989 and has since been modified <br /> two times; and <br /> <br />WHEREAS, the requested modification is reasonable and would not <br /> violate the original intent of this PUD; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed major <br /> modification to the approved planned unit development; <br /> and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br /> requirements of the California Environmental Quality Act <br /> (CEQA); and <br /> <br />WHEREAS, a duly noticed public hearing was held on July 2, 1991; <br /> and <br /> <br />WHEREAS, the City Council finds that this major modification is <br /> consistent with the General Plan policies of the City of <br /> Pleasanton. <br /> <br /> <br />
