CITY COUNCIL OF THE CITY OF pLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1624 <br /> <br /> AN ORDINANCE AlPROVING THE APPLICATION OF <br /> RONALD AND KAY VELLA FOR A MAJOR <br /> MODIFICATION TO AN APPROVED PUD DEVELOPMENT <br /> PLAN AS FILED UNDER CASE PUD-85-15-4M <br /> <br />WHEREAS, Ronald and Kay Vella applied for a major modification to an approved PUD <br /> Development Plan for the Golden Eagle Farms subdivision, to reduce the required <br /> interior side setback to 17'11" for the western side yard of Lot 57 located at 8519 <br /> Lupine Court; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - Low Density <br /> Residential District; and <br /> <br /> WHEREAS, this application is categorically exempt from the requirements of the California <br /> Environmental Quality Act; and <br /> <br /> WHEREAS, Council received the Planning Commission' s recommendations for approval of the <br /> proposed major modification to the approved planned unit development; and <br /> WHEREAS, a duly noticed public hearing was held on May 3, 1994; and <br /> <br /> WHEREAS, the City Council finds that this major modification is consistent with the General <br /> Plan policies and purposes of the PUD ordinance of the City of Pleasanton <br /> THE CITY COUNCIL OF THE CITY OF pLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> ~: Approves Case pUD-85-15-4M, the application of Ronald and Kay Vella for a <br /> major modifxeation to an approved PUD Development Plan for the Golden Eagle <br /> Farms subdivision, to reduce the required interior side setback to 17'11" for the <br /> western side yard of Lot 57 located at 8519 Lupine Court, subject to the <br /> foliowing conditions: <br /> <br /> 1. The proposed siting of the residence and the landscape planting shall <br /> conform substantially to the revised site and landscape plans, Exhibit A <br /> (dated "Received April 6, 1994"), on file with the Planning Department. <br /> <br /> 2. The fxve foot westerly side yard setback reduction applies only for this <br /> house plan on this lot and shall not apply to any other lot within this <br /> development (PUD-85-15). <br /> <br /> <br />
