CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1620 <br /> <br /> AN ORDINANCE AMENNDING CHAPTER 6.52 OF THE <br /> PLEASANTON MUNICIPAL CODE BY ADDING THERETO <br /> SECTION 6.52.150 TO PROVIDE FOR (1) REGULATION <br /> OF BASIC SERVICE TIER RATES AND RELATED <br /> EQUIPMENT, INSTALLATIONS, AND SERVICE <br /> CHARGES, AND (2) CUSTOMER SERVICE STANDARDS <br /> OR ANY CABLE TELEVISION SYSTEM OPERATING IN <br /> THE CITY OF PLEASANTON <br /> <br />WHEREAS, on November 5, 1985, the City adopted Ordinance No. 1224, the City of <br /> Pleasanton Cable Television Franchise Ordinance, adding a new Chapter 6.52 to <br /> the Pleasanton Municipal Cede; and <br /> <br />WHEREAS, effective December 13, 1985, the City ("Grantor") and Tele-Vue Systems, Inc., <br /> doing business as Viacorn Cablevision, of Viacorn International, Inc. CViacom") <br /> entered into an agreement whereby the City granted to Viacorn a non-exclusive <br /> franchise to operate a cable television system in the City; and <br /> <br />WHEREAS, on October 5, 1992, the United States Congress enacted the Cable Television and <br /> Consumer Protection and Competition Act of 1992 which, among other things, <br /> provided that a franchising authority may regulate basic service rates and charges <br /> and set customer service standards in accordance with FCC (Federal <br /> Communications Commission) regulations; and <br /> <br />WHEREAS, on April 1, 1993, the FCC prescribed such regulations, which are set forth at 47 <br /> CFR (Code of Federal Regulations) 76.900 - 76.985 and 76.309 (the "FCC Cable <br /> Regulations"). <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> ~: Chapter 6.52 of the Pleasanton Municipal Code is amended by adding a new <br /> Section 6.52.150 to read as follows: <br /> <br /> <br />
