CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1607 <br /> <br /> AN ORDINANCE AMENDING CHAPTER 13 · 0 4 OF THE <br /> PLEASANTON MUNICIPAL CODE REGARDING SIDEWALK <br /> DINING AND DECORATIVE DISPLAYS IN THE DOWNTOWN <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Section 13.04,010 of the Pleasanton Municipal Code is <br /> amended to read as follows: <br /> <br /> (Subsections A - I, no change) <br /> <br /> J. "Sidewalk Dining" means the use of a public <br /> sidewalk for the placement of tables, chairs, <br /> benches, and related items for the purpose of <br /> serving food and/or beverages in conjunction with <br /> and adjacent to an indoor restaurant, delicatessen, <br /> or ice cream/yogurt shop. <br /> <br />Section 2: Section 13.04,435 of the Pleasanton Municipal Code is <br /> amended to read as follows: <br /> <br /> "13.04.435 Sidewalk Dining/Sidewalk Decorative <br /> Displays <br /> <br /> A. Permit Required: A sidewalk dining/decorative <br /> display permit shall be required for any tables, <br /> chairs, benches, displays, or other appurtenances <br /> placed in the public right-of-way for the purpose <br /> of establishing a sidewalk dining area or sidewalk <br /> decorative display. The Zoning Administrator shall <br /> issue such permit upon a finding that the <br /> requirements of this section have been met. <br /> <br /> (Paragraph B, no change) <br /> <br /> C. Procedure: Establishment of a sidewalk dining area <br /> or sidewalk decorative display shall require design <br /> review approval and issuance of a sidewalk <br /> dining/decorative display permit by the Zoning <br /> Administrator. The Zoning Administrator shall <br /> follow the procedures of Section 18.20.120C of this <br /> code (design review) prior to issuing a sidewalk <br /> dining/decorative display permit, except that <br /> notices for sidewalk dining areas serving alcoholic <br /> <br /> <br />
