Ordinance No. 1607 <br />Page 2 <br /> <br /> beverages shall be sent to all property owners and <br /> businesses within 300 feet of the proposed site. <br /> The Zoning Administrator may establish conditions <br /> of approval for the sidewalk dining area or <br /> sidewalk decorative display as necessary to achieve <br /> the requirements of this section. <br /> <br /> Upon receipt of an application for sidewalk dining <br /> serving alcoholic beverages, the Zoning <br /> Administrator shall refer the application to the <br /> Chief of Police for his/her review and comment. <br /> Approval of the sidewalk dining permit by the <br /> Zoning Administrator shall also fulfill the <br /> requirements of Chapter 10.20 of this code. <br /> <br /> D. Standards: The following standards shall be met <br /> for the establishment and maintenance of a sidewalk <br /> dining area or sidewalk decorative display within <br /> the public right-of-way: <br /> <br /> 1. Physical Requirements. <br /> <br /> a. A four foot unobstructed sidewalk <br /> clearance for pedestrians shall be <br /> maintained at all times from a table, <br /> chair, bench, display, planter, or any <br /> other appurtenance used as part of a <br /> sidewalk dining area or sidewalk <br /> decorative display, and a two foot <br /> clearance shall be maintained from the <br /> face of curb to any such appurtenance. <br /> <br /> (subparagraph b, no change) <br /> <br /> c. On a corner lot, no sidewalk dining area <br /> or sidewalk decorative display shall be <br /> located within the area bounded by the <br /> extensions of the corner building walls <br /> between the building and the curb. <br /> <br /> (subparagraph d, no change) <br /> <br /> e. All sidewalk dining furniture and <br /> sidewalk decorative displays shall be <br /> removed daily after business hours, <br /> except that planters or other approved <br /> barriers around a sidewalk dining area <br /> may remain if unable to be easily moved. <br /> <br /> (subparagraph f, no change) <br /> <br /> <br />
