PLANNiNG COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-99-15 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF SHIN AND LINDA WEI FOR <br />CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, AS FILED <br />LrNDER CASE UP-99-2/Z-99-36 <br /> <br />Shin and Linda Wei have applied for conditional use permit and design review <br />approvals to allow the construction of an approximately 1,000 square-foot, one <br />story detached second unit approximately 15 feet in height located at 6237 Detjen <br />Court; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit Development - Low <br /> Density Residential and Open Space) District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of February 24, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, <br /> <br />projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a detached second unit conforms with the <br />objectives and purposes of the zoning ordinance, the proposed second unit <br />ordinance, and the standards and purposes of the PUD for The Preserve. <br />A second unit is considered to be a single family use. The proposal would <br />maintain the existing single-family character of the development because <br />the second unit is designed to match the home, would maintain the main <br />structure setbacks, and would not exceed (in combination with the existing <br />home's floor area) the FAR for the development. In addition, a <br />recommended condition of approval requires that either the primary <br />residence or the second trait be owner-occupied and that a maximum of <br />two adults be allowed to reside in the second unit.
