to live in the main structure with the second unit functioning for housing <br />for parents or other elderly extended-family members. <br /> <br />The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Due to the limited size of the second unit, and its proposed use for older <br />family members, traffic generated by use of the unit should not be <br />significantly greater than that of a single-family residence and may even <br />be less given the unit's potential residents. A condition of approval <br />requires an off-street parking space for the second trait to be provided by <br />utilizing one of the two extra garage spaces. <br /> <br />The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The proposed second unit would be detached from the main single-family <br />home. The structure would be in compliance with all applicable building <br />codes, City development standards, and development standards unique to <br />the PUD for The Preserve. It also would be compatible with the proposed <br />second unit ordinance as recommended by the Planning Commission. <br /> <br />WHEREAS, <br /> <br />the Planning Commission determined that the proposal is in compliance with <br />State law and the applicable Municipal Code regulations; meets the requirements <br />of the new second unit ordinance as recommended for approval by the Planning <br />Commission; and meets the required findings for a conditional use permit. As <br />conditioned, the proposal would maintain the character of the existing <br />single-family residence and there would be no impacts on adjacent neighbors. <br /> <br />NOW, THEREFORE, THE PLANN1NG COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-99-02/Z-99-36, the application of Shin and Linda Wei for <br />conditional use permit and design review approvals to allow the construction of <br />an approximately 1,000 square-foot, one story detached second unit <br />approximately 15 feet in height located at 6237 Detjen Court, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br /> <br />
