PLANNiNG COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC~99-01 <br /> <br />RESOLUTION APPROViNG THE APPLICATION OF WAL-MART STORES, INC. <br />FOR A CONDITIONAL USE PERMIT, AS FILED UNDER CASE UP-98-75 <br /> <br />WHEREAS, <br /> <br />Wal-Mart Stores, Inc. has applied for a conditional use permit to allow the sale of <br />firearms within the existing retail store located at 4501 Rosewood Drive (Metro <br />580 Shopping Center); and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) - I/C-O <br /> (Industrial/Commercial - Office) District; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of January 13, 1999, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, <br /> <br />projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />As conditioned, the use would be consistent with the general provisions of the <br />Zoning Ordinance. The general provisions of the Zoning Ordinance state that the <br />objective of the ordinance is to protect and to promote the public health, safety, <br />peace, comfort, convenience, prosperity and general welfare. The main intent of <br />requiring a conditional use permit for the sale of firearms is to protect and <br />promote the public safety by ensuring that dealers are located a safe distance away <br />from residences, schools, parks, and other sensitive uses and by ensuring that the <br />firearms are stored, sold, and monitored in a way to deter theft. The proposed use <br />is located a safe distance away from these uses since the apartment complex and <br />park are located on the opposite side of the major arterial, Owens Drive, Wal-Mart <br />is set back approximately 120 feet from Owens Drive, and Wal-Mart is in a large <br />retail complex which people typically do not walk or drive through unless they <br />will be shopping at the center. <br /> <br /> <br />
