Resolution No. PC-99-01 <br />Page 2 <br /> <br />In addition, to deter theft, Wal-Mart has stated that it would trigger lock all of its <br />displayed firearms, all displayed firearms would be locked in a glass case, the <br />glass case and the sporting goods counter would be monitored by a video camera, <br />the sporting goods section of the store would always be staffed, only the store <br />manager or an assistant manager would have keys to the gun room and display <br />case, and the store manager or an assistant manager would walk a firearm <br />customer to the front exit after the customer had been given his/her firearm <br />pumhase. Overall Wal-Mart is storing, monitoring, and distributing firearms in an <br />adequately safe manner. <br /> <br />The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The residential use and park closest to the Metro 580 is an apartment complex and <br />neighborhood park which are under construction. It is not likely that firearm sales <br />at Wal-Mart would impact the apartment complex/park due to its location and <br />since Wal-Mart is located in a major retail center, not a neighborhood center. <br />Similarly, as operated and conditioned, adequate safety measures would be <br />provided to aid in deterring theft. <br /> <br />The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Wal-Mart is now complying with the City's trigger lock requirements, and a <br />condition of approval has been added that a trigger lock be provided with all <br />firearms sold. As operated and conditioned, the firearm sales would be in <br />compliance with all other applicable chapters of the Zoning Ordinance. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br /> appropriate for the location. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-98-75, the application of Wal-Mart Stores, Inc. for a <br />conditional use permit to allow the sale of firearms within the existing retail store <br />located at 4501 Rosewood Drive (Metro 580 Shopping Center), subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br /> <br />
