CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br />RESOLUTION NO. 77-14 <br /> <br /> A RESOLUTION AUTHORIZING AMENDMENT TO THE CITY ATTORNEY'S <br /> BUDGET FOR PAYMENT OF VALLEY COMMUNITY SERVICES DISTRICT <br /> LITIGATION COSTS IN ACCORD WITH THE 1972 SETTLEMENT <br /> AGREEMENT <br /> <br />WHEREAS, on November 9, 1972 a Settlement Agreement was entered <br /> into by the City of Pleasanton, Valley Community Services <br /> District and various developers in order to settle <br /> litigation involving the provision of sewage capacity at <br /> the Valley Community Services District sewage treatment <br /> plant; and <br /> <br />WHEREAS, Paragraph 13 of said agreement required the City of <br /> Pleasanton to defend and hold harmless the District from <br /> any and all causes of action arising out of any dispute <br /> between users within the Pleasanton area and the City of <br /> Pleasanton; and <br /> <br />WHEREAS, litigation has arisen with respect to the allocation of <br /> Pleasanton's capacity at the Valley Community Services <br /> District plant which has caused litigation to be brought <br /> against Valley Community Services District; and <br /> <br />WHEREAS, Valley Community Services District attorneys (Wilson, <br /> Jones, Morton & Lynch) provided a cost billing to the <br /> City Attorney's Office of $587.50 to pay for said <br /> legal services to defend Valley Community Services Dis- <br /> trict; and <br /> <br />WHEREAS, the City Attorney on January 5, 1977 sent a memorandum <br /> to the City Council explaining the need for payment of <br /> the billing from VCSD's attorneys; and <br /> <br /> <br />
