<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-36 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF <br />VRANEK (EARLY YEARS CHILDREN'S CENTER) <br />DESIGN REVIEW APPROVAL, AND A VARIANCE, <br />UP-95-03, Z-95-13, AND V-95-07 <br /> <br />FRANK AND SHERYL <br />FOR A USE PERMIT, <br />AS FILED UNDER CASE <br /> <br />WHEREAS, Frank and Sheryl Vranek (Early Years Children's Center) <br />have applied for a use permit and design review approval <br />to construct an approximately 3,477 square foot building <br />to be utilized for additional classroom area, and a <br />variance for a fence in the front yard setback, at the <br />Early Years Children's Center located at 1251 Hopyard <br />Road; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 14, 1995, the <br />Planning Commission, after considering all public <br />testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application, approved the <br />negative declaration for this project; and <br /> <br />WHEREAS, the Planning Commission made the following use permit <br />findings: <br /> <br />A. The proposed location of the conditional use is in <br />accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The City's Municipal Code permits the establishment <br />of nursery schools in residential areas with <br />approval of a use permit. The term "nursery <br />schools" is interpreted to include the more modern <br />day care center catering to children of various <br />ages. Day care centers, with their need for <br />substantial yard areas, are an appropriate use for <br />a residential area. Childcare centers typically do <br />not generate a substantial amount of traffic and, <br />the majority of drop-off and pick-up will occur <br />during the early morning and early evening "rush <br />hours" as parents are going to work or returning <br />from work. These "high volume" hours are typical <br />of any residential neighborhood. Furthermore, the <br />center is located on the periphery of a residential <br />area on a maj or street, so traffic through the <br />adjacent streets will be avoided. <br />
