1 <br />AQUATIC CENTER RENTAL AGREEMENT <br />PLEASANTON SEAHAWKS <br /> <br /> <br />THIS AQUATIC CENTER RENTAL AGREEMENT is entered into September <br />1, 2025 by the CITY OF PLEASANTON, a municipal corporation (City), and the <br />PLEASANTON SEAHAWKS, a non-profit corporation (Seahawks). <br /> <br />RECITALS <br /> <br />WHEREAS, City owns an aquatic center complex, known as the Dolores Bengtson <br />Aquatic Center (DBAC), at 4455 Black Avenue in Pleasanton; and <br /> <br />WHEREAS, Seahawks is a Pleasanton-based non-profit organization devoted to the <br />development of a youth competitive swimming program; and <br /> <br />WHEREAS, Seahawks desire to schedule time to use the 50-meter and 25-meter pool <br />at the DBAC; and <br /> <br />WHEREAS, Seahawks recognize City’s objective is to provide programs to meet a <br />variety of community swimming needs, pay for costs of operation, and if possible, provide <br />scheduled use for the Seahawks and other Pleasanton-based organizations; and <br /> <br />WHEREAS, City is willing to schedule pool time for Seahawks and its swimmers <br />(“team members” or “swimmers”) subject to certain terms and conditions. <br /> <br />NOW, THEREFORE, in exchange for valuable consideration, the receipt of <br />which is hereby acknowledged, the parties hereto agree as follows: <br /> <br />1) Seahawks Use of 50 and 25 Meter Pools. <br /> <br />a) Scheduled Use. City is willing to provide Seahawks swimmers with scheduled <br />times for use of the 50-meter and 25-meter lap pool use at the DBAC. The <br />scheduled pool times for use by the Seahawks is more specifically set forth in <br />Exhibit B. <br /> <br />b) Advance Notice of Cancelled Practice. Seahawks shall provide City’s Recreation <br />Supervisor with written email notice at [email protected] of <br />Seahawks practice cancellations at least ten (10) days in advance to be eligible for a <br />fee adjustment on their monthly bill. Requests submitted less than ten (10) business <br />days in advance will not be eligible for adjustments. <br /> <br />c) Swim Meets. All Seahawks swim meets proposed for the DBAC shall be <br />scheduled as space is available, which shall be determined at City's discretion.
