RESOLUTION NO. 2025-020 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE AFFORDABLE HOUSING AGREEMENT WITH SQUARE MILE PLEASANTON, LLC FOR THE MULTI-FAMILY AFFORDABLE RENTAL HOUSING PROJECT AT 3300 BUSCH ROAD, PART OF THE VILLAGES AT THE QUARRY RESIDENTIAL DEVELOPMENT WHEREAS, Square Mile Pleasanton, LLC has made an application to the City for an Affordable Housing Agreement related to its 102-unit multi-family residential project as part of its Villages at the Quarry project on an approximately XX-acre portion of the 51.62-acre site identified in the City's adopted 2023 Housing Element as the Kiewit Site, located at 3300 Busch Road (Housing Site Compliance Review (Case No. P23-0480) and Vesting Tentative Map 8680 ("the Project"); and WHEREAS, on April 23, 2025, the Planning Commission approved the above-referenced applications for ); and reviewed and recommended approval of the Affordable Housing Agreement for the Project; and WHEREAS, the Affordable Housing Agreement (AHA) provides that Square Mile Pleasanton, LLC shall construct the multi-family residential project consisting of 101 deed- restricted affordable units and one unrestricted staff unit for a total of the 102 multi-family rental units to be available to households with incomes at or below 80 percent (low-income) of the Area Median Income (AMI) to comply the Project's requirements under the Inclusionary Zoning Ordinance, subject to further provisions as outlined in the AHA; and WHEREAS, a duly noticed public hearing was held by the City Council on May 20, 2025, at which time the public was given the opportunity to comment on the Affordable Housing Agreement; and WHEREAS, the City Council considered all the information regarding the terms of the Affordable Housing Agreement. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. CEQA Findings. The City Council has independently reviewed and analyzed the 15183 Consistency Checklist prepared for the Project pursuant to the City of Pleasanton 2023- 2031 (6th Cycle) Housing Element Update Environmental Impact Report (SCH# 2022040091) (Housing Element Update Final EIR or FEIR) and has considered the information contained therein. The City Council finds the CEQA Guidelines Section 15183 Consistency Checklist and Mitigation Monitoring and Reporting Program (MMRP) prepared for the Project pursuant to the City of Pleasanton Housing Element Update FEIR satisfies the requirements of CEQA and represents the independent judgment and analysis of the City of Pleasanton as lead agency for the Project. Accordingly, the City Council makes the following findings for adoption of the 15183 Consistency Checklist and MMRP prepared for the Project pursuant to the City of Pleasanton Housing Element Update FEIR: 1. There are no new significant effects peculiar to the Project or its site;
