<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-23 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF PRESLEY HOMES OF <br />CALIFORNIA FOR DESIGN REVIEW AND A CONDITIONAL USE PERMIT, AS <br />FILED UNDER CASE UP-96-86/Z-96-257 <br /> <br />WHEREAS, the Presley Homes of California has applied for design review approval for the <br />Laurel Creek production homes and for a master conditional use permit to allow <br />au pair units in production homes located at the southwest corner of Dublin <br />Canyon Road and Foothill Road; and <br /> <br />WHEREAS, zoning for the property is PUD - LDR/OS (Planned Unit Development - Low <br />Density Residential and Open Space) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of February 26, 1997, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose ofthe district in which <br />the site is located. <br /> <br />Each lot in the Laurel Creek subdivision is zoned PUD-LDR, which allows the <br />permitted and conditional uses of the R-I-20,000 zoning districts; second units are <br />a conditional use in the R -I districts. As designed, the proposed second units <br />would be visually integrated and compatible with the appearance of the primary <br />residence, thereby maintaining the large-lot single-family character of the <br />subdivision. As conditioned, a lot owner with a second unit would have the <br />ability to rent one or the other of the dwelling units on the property, while <br />maintaining occupancy ofthe other. A maximum number of 42 second units <br />would be possible if all buyers of Plans I and 2 opted for the second unit. The <br />proposed master use permit to allow second units with two of the proposed seven <br />house plans conforms to the objectives and purposes of the zoning ordinance and <br />PUD for the project. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />
