<br />Resolution No. PC-97-23 <br />Page 2 <br /> <br />Each of the two proposed house plans provides either a three or four-car <br />garage and at least three open on-site parking spaces located on the <br />back-out apron in front of the garages. A condition of approval requires <br />that at least one space be made continuously available for the second unit <br />so that adequate off-street parking is provided for residents of the second <br />units. The location ofthe second units must follow the developments <br />standards (setbacks, FAR, height, etc.) for accessory and main structures <br />as indicated in the approved PUD so no unit would have any greater <br />impact on adjacent properties than any other main or accessory structure <br />which could be constructed on a lot. Each ofthe proposed units is located <br />in a one-story structure, so no unit would have a view impact into the side <br />and rear yards of adjacent properties. The second unit would be <br />constructed in conformance with all applicable City building and fire <br />codes. The master conditional use permit for the second units would not <br />be detrimental to the public health, safety, and welfare. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The second units to be allowed under this master use permit are designed <br />specifically for the primary residences of the Laurel Creek project. As designed <br />and conditioned, the units would meet all criteria established by the State and City <br />for their design and use. <br /> <br />WHEREAS, the master conditional use permit and design review are covered by the <br />Environmental Impact Report certified by the City Council for the Laurel Creek <br />development (PUD-89-21); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed master use permit for <br />second units and the proposed house designs are appropriate for the project. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-96-86 and Z-96-257, the application of the Presley Homes of <br />California for design review approval for the Laurel Creek production homes and <br />for a master conditional use permit to allow au pair units in production homes <br />located at the southwest corner of Dublin Canyon Road and Foothill Road, subject <br />to the conditions shown in Exhibit "B-1" and "B-2," attached hereto and made <br />part of this case by reference. <br /> <br />Section 2 <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
