<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-05 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DEL <br />VALLE COURT HOMEOWNERS' ASSOCIATION FOR A MAJOR MODIFICATION <br />TO AN APPROVED DEVELOPMENT PLAN AS FILED UNDER CASE <br />PUD-90-08-1M <br /> <br />WHEREAS, Del Valle Court Homeowners' Association has applied for a major modification to <br />an approved development plan to construct a gate across the entry to Del Valle <br />Court (west side of Stanley Boulevard between Main Street and Stanley <br />BoulevardlFirst Street); and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - MDR (Medium <br />Density Residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 22,1997, the Planning <br />Commission considered all public testimony, relevant exhibits and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The plan is in the best interests of the public health, safety, and general <br />welfare. <br /> <br />The gate is designed according to the requirements of the City's Fire and Building <br />Departments and will provide Knox-key or Knox-box overide systems for <br />emergency response. <br /> <br />B. The plan is consistent with the City's General Plan. <br /> <br />Although the City's General Plan does not encourage further gated communities, <br />it does not prohibit them; therefore, the gate is consistent with the General Plan. <br /> <br />C. The plan is compatible with previously developed properties in the <br />vicinity and the natural, topographic features of the site. <br />
