AN AGREEMENT TO PERMIT CONNECTION TO AND USE OF <br />COUNTY SERVICE AREA R- 1967-1 SANITARY SEWER SYSTEM <br />BETWEEN <br /> COUNTY OF ALAMEDA AND CITY OF PLEASANTON <br /> <br />S AGREEMENT is made and entered into as of this ~-'/ff/.-, day of <br />,1994 by and between the CITY OF PLEASANTON (hereinafter referred <br />~to ~as "CITY") and the COUNTY OF ALAMEDA for County Service Area R-1967-1 <br />(hereinafter referred to as "COUNTY"). <br /> <br />Witnesseth: <br /> <br /> WHEREAS, COUNTY has authorized County Service Area R-1967-1, <br />Castlewood, hereinafter referred to as "CSA", to provide, among other services, sewage <br />service; and <br /> <br /> WHEREAS, CITY has agreed to provide sewage treatment and effluent export <br />services for the CSA; and <br /> <br /> WHEREAS, CITY has entered into an agreement with COUNTY to operate and <br />maintain the CSA pump station and force main; and <br /> <br /> WHEREAS, CITY has approved by Resolution No. 92-217, the tentative map for <br />Tract 6563, a private property located west of Foothill Road and south of CSA, in order <br />to subdivide the property for 38 (thirty-eight) residential lots; and <br /> <br /> WHEREAS, CITY and property owner of Tract 6563 entered into a <br />preannexation agreement to require property owner of Tract 6563 to comply with all <br />City Ordinances, laws and regulations; and <br /> <br /> WHEREAS, CITY and property owner of Tract 6563 entered into an agreement <br />granting property owner of Tract 6563 sewage capacity within the CITY'S allocation <br />of sewage processed by Livermore-Amador Valley Wastewater Management Agency <br />and Dublin-San Ramon Services District facilities, said capacity in addition to those <br />Residential Discharge Equivalents purchased by the COUNTY for the County Service <br />Area R-1967-1; and <br /> <br /> WHEREAS, COUNTY has released guarantee bonds for a sewer main <br />constructed on Foothill Road between the CSA pump station and Oak Lane; and <br /> <br /> WHEREAS, CITY has required property owner of Tract 6563 to connect to <br />COUNTY's existing CSA sewer system prior to its flow into CITY's sewer system; <br /> <br /> NOW, THEREFORE, in consideration of the acknowledgments made above and <br />mutual promises as provided herein, CITY and COUNTY agree as follows: <br /> <br />Page 1 of 5 <br /> <br /> <br />
