<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-35 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF STANDARD PACIFIC OF <br />NORTHERN CALIFORNIA FOR A CONDITIONAL USE PERMIT, AS FILED <br />UNDER CASE UP-98-11 <br /> <br />WHEREAS, Standard Pacific of Northern California has applied for a conditional use permit <br />for an approximately 480 square foot secondary unit to be constructed within a <br />home under construction at 8046 Rockford Place and a 530 square foot attached <br />secondary unit to be constructed within a home under construction at 8062 <br />Rockford Place; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR/RDR (Planned Unit Development- Low <br />Density Residential/Rural Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 13, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a secondary unit within the two existing <br />residences conforms with the objectives and purposes of the zoning <br />ordinance and the purpose of the Oak Tree Farm PUD. State law <br />considers secondary units as a single-family use. The proposal would <br />maintain the existing single-family character of the Oak Tree Farm <br />development because the units are designed as part of the homes, <br />indistinguishable from the exteriors as a secondary unit. Each secondary <br />unit only constitutes 9.6 of the total house living area In addition, a <br />recommended condition of approval -- standard for all secondary units in <br />the City -- requires that either the primary residence or the secondary unit <br />be owner-occupied and that a maximum of two adults shall be allowed to <br />reside in the unit. This condition is required to be recorded with the deed <br />
