PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-98-01

RESOLUTION APPROVING THE APPLICATION OF LAURA DARROW FOR A
NON-EXEMPT HOME OCCUPATION PERMIT, AS FILED UNDER CASE UP-97-56

WHEREAS, Laura Darrow has applied for a non-exempt home occupation permit to conduct
piano and voice lessons in an existing residence located at 7760 Cottonwood
Lane; and

WHEREAS, zoning for the property is R-I-6,500 District; and

WHEREAS, at its duly noticed public hearing of January 14, 1998, the Planning Commission
considered all public testimony, relevant exhibits, and recommendations of the
City staff concerning this application; and

WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Enviromnental Quality Act (CEQA); therefore, no enviromnental
document was prepared for this project.

WHEREAS, the Planning Commission made the following findings:

A. The proposed location ofthe conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

Chapter 18.32 (One-Family Residential Districts) of the Municipal Code states
that a home occupation operated in accordance with the requirements listed in
Chapter 18.104 (Home Occupations) is a conditional use in the R-I district. Some
of the objectives ofthe R-I district are to protect residential property from the
hazards, noise, and congestion created by commercial and industrial traffic, and to
protect properties from noise, illumination, unsightliness, odors, dust, dirt and
other objectionable influences. The objective of Chapter 18.104 is to permit
occupations which traditionally take place in residences if they do not adversely
affect the residential character of the neighborhood.

The potential impacts associated with home occupation music lessons are noise,
parking, and traffic. In order to reduce the level of any noise generated by the
home occupation, the applicant would be required to install a dual-pane window
in the room where the lessons take place. The window would have to be shut
during lessons. By limiting the number of daily lessons to eight and requiring
clients to park on the driveway or on the street directly in front of the residence,
