9. Violation. The failure of Owner to constantly abide by the <br />terms of this permit shall be a violation of the Ordinance Code of the City <br />of Pleasanton and shall submit Owner to all penalties attendant thereto. <br /> <br />Upon the occurrence of any violation, discharge by Owner to the sewage system <br />shall cease until Owner meets all of the discharge requirements of this permit. <br /> <br /> 10. Indemnification. Owner shall hold the City of Pleasanton, its <br />City Council, officers, and agents harmless from and defend any suits, fines, <br />penalties, cease and desist orders, or other actions caused in whole or in <br />part by Owner's violation of this permit, modifications thereto or written <br />notices from the City and pay any fines, penalties, judgments or other financial <br />obligations incurred as a result of Owner's violation of this permit. <br /> <br /> Owner shall reimburse City for any costs incurred for liti- <br />gation expense, including attorneys' fees, in order to enforce this permit. <br /> <br /> 11. Notification. All notices by this Permit shall be made in <br />writing and personally delivered or mailed, postage paid, to: <br /> <br /> 12. Waiver.
