PROPOSED <br />DEVELOPMENT DEFERMENT AGREEMENT <br /> <br /> THIS DEVELOPMENT DEFERMENT AGREEMENT (the "Agreement") <br /> <br /> is made this __ day of , 1981, by and between <br /> <br /> THE STONESON DEVELOP~ENT CORPORATION, a California corporation <br /> ("Stoneson"), and the CITY OF PLEASANTON, a municipal corporation <br /> { "Pleasanton" ) . <br /> <br /> RECITALS <br /> <br /> A. Stoneson is the owner in fee of certain unimproved <br /> real property (the "Property") located in Pleasanton, California, <br /> designated as certain lots in Tract 3150, more particularly <br /> described in Exhibit A attached to this Agreement. <br /> <br /> B. Stoneson has purchased and now has outstanding <br />eighty-five (85) D.U.E. (Dwelling Unit Equivalent) sewer-system <br />connection permits for use in development of the Property, such <br />permits having been issued by the Dublin-San Ramon Services <br />District ("DSRSD") pursuant to Alameda County Superior Court Orders <br />in Civil Action No. 423134 filed December 19, 1972 and April 22, <br />1980 (the "Court OrderS"). Thirty-seven of these permits, bearing <br />Permit No. P-104, were issued to Stoneson on September 13, 1978, <br />and nine of such permits, bearing Permit No. P-112, were issued to <br />Stoneson on January 16, 1979 (the forty-six sewer permits herein- <br />after collectively referred to as the '~Sewer Permits"). <br /> <br /> C. Pursuant to the 1972 Court Order, building permits <br />must be obtained within three (3) years after purchase of any <br />sewer-System connection permits, or such sewer permits shall be <br />cancelled. <br /> <br /> <br />
