Section 2: In approving the appeal of Mr. Mavridis, Council <br /> makes the following findings in support of the <br /> variance: <br /> <br />That because of special circumstances applicable <br />to the subject property, including size, <br />shape, topography, location or surroundings, <br />the strict application of the provisions of <br />the Zoning Code would deprive the property of <br />privileges enjoyed by other properties in the <br />vicinity and under identical zoning classification. <br /> <br />That the granting of the variance will not <br />constitute a grant of special privilege <br />inconsistent with limitation on other properties <br />classified in the same zoning district. <br /> <br />That the granting of the variance will not be <br />detrimental to the public health,safety or <br />welfare or be materially injurious to properties <br />or improvements in the vicinity. <br /> <br />Section 3: The variance is granted subject to the following <br /> conditions: <br /> <br />That the development be substantially as <br />shown on the site plan, elevations and landscape <br />plan, Exhibit A, on file with the Planning <br />Division except that the porch on the east <br />side of the commercial structure shall be <br />removed and a new exit provided. <br /> <br />That the applicant be aware that if this <br />appeal is granted it will be necessary to <br />submit design plans of the triplex to the <br />Design Review Board for consideration prior <br />to issuance of a building permit. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED NOVEMBER 10, 1981 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood <br /> and Mayor Mercer <br /> <br />ABSENT: None <br /> <br /> er, C Cler~ <br />By Doris George, Deputy City Clerk A~OVED AS <br />rTvey~E.L <br />Ha evine, City Attorney <br /> <br /> <br />
