Section 20. Resignation, Reinstatement and Layoff <br /> <br />20.1 <br /> <br />Automatic Resignation <br /> <br />Failure to return at the expiration of a leave of absence <br />or being absent without leave shall be considered an <br />automatic resignation. Such a resignation may be <br />rescinded by the City Manager if the employee submits <br />satisfactory reasons for his/her absence within three days <br />of the date his/her resignation was effected. <br /> <br />20.2 <br /> <br />Voluntary Resignation <br /> <br />An employee may resign in good standing by submitting to <br />the Personnel Officer a written resignation stating the <br />reasons therefor and effective date thereof at least <br />two (2) weeks prior thereto. <br /> <br />A statement as to the resigned employee's performance <br />shall be forwarded to the Personnel Officer by the <br />department head. <br /> <br />20.3 <br /> <br />Reinstatement <br /> <br />With the approval of the Personnel Officer, a permanent <br />or probationary employee who has resigned in good standing <br />may be reinstated within two (2) years of the effective <br />date of resignation, to a vacant position in the same or <br />comparable class. Upon reinstatement, the employee, for <br />all purposes, shall be considered as though he/she had <br />received a new appointment. <br /> <br />20.4 Layoff <br /> <br />The Appointing Authority may layoff an employee in the <br />competitive service because of material changes in duties, <br />organization or shortage of work or funds. <br /> <br />The employee in the classification in which the Appointing <br />Authority is laying off who has the least length of total <br />continuous service in the classification shall be laid off <br />first. Should additional layoffs become necessary the <br />seniority of employees having previously changed classi- <br />fications through displacement shall include their years <br />of service in higher sworn paying classifications. The <br />employee shall be notified of his/her layoff in writing <br />together with the reasons therefor. <br /> <br />-20- <br /> <br /> <br />
