b. 4.5% of the construction cost for construction staking and job <br /> coordination, payable in four equal payments during the construction <br /> period (not including inspection); <br /> <br /> c. 1% of the total project cost for the assessment proceedings required <br /> of the Engineer, payable upon receipt of the proceeds of assessments <br /> collected and/or bonds sold. <br /> <br /> d. Printing and other services ordered by City shall be paid by City on <br /> a time and materials basis in accordance with the rate schedule at- <br /> tached hereto as Exhibit A. The printing costs shall be included in <br /> the incidental costs of the district. <br /> <br /> The above amount shall be paid by City out of the proceeds of assess- <br />ments levied and bonds to be issued in said proceedings. In no event, however, <br />will the compensation of Engineer exceed the amount set forth by Engineer for that <br />purpose in the report, or any amended report, prepared by him under Section 10204 <br />of the Streets and Highways Code. <br /> <br /> 4. In the event said proceedings are not carried through to conclusion, <br />or shall be abandoned, then Engineer shall receive no{hing. <br /> <br /> 5. City agrees that in accordance with generally accepted construction <br />practices, the construction contractor will be required to assume sole and com- <br />plete responsibility for job site conditions during the course of construction of <br />the project, including safety of all persons and property; that this requirement <br />shall be made to apply contTnuously and not be limited to normal working hours. <br /> <br />Dated: January ll, 1982 <br /> <br />ATTEST: <br /> <br />JAMES R.
