Attendance at meetings of City Council, when requested by City staff, for the purpose of presenting and seeking approval of the documents and reports described in subparagraphs a. through c. ~ Attendance at all other public meetings of City at which matters re- lating to the assessment district are considered, except routine matters. h. Attendance at staff meetings or meetings of property owners upon the request of the City, after reasonable notice. i. Telephone consultation with staff members and property owners to an- swer engineering questions about the assessment proceedings. j. Preparation of Change orders as may be required during the course of construction. k. Preparation of a final cost schedule after completion of the i~prove~ ment and payment of all incidental expenses. 2. The services of Engineer under this agreement shall not include the following: Preparation of an environmental assessment to determine whether the improvement will have a significant impact on the environment within the meaning of the California Environmental Quality Act. b. Preparation of an Environmental Impact Report. c. Inspection of the work of City's contractor and certificationto the City of contractor's entitlement to progress payments. d. Work on bond segregations and/or subdivision and parcel maps. e. On-site construction review or negotiations in connection with right- of-way acquisition. The performance by Engineer of services excluded by this paragraph, if required by City, shall be under separate oral or written agreement. 3. In consideration of the services set forth in paragraph l, City shall pay to Engineer the following fee and costs: 7.5% of construction cost (including contingencies) for completion of the plans and specifications, payable upon receipt of the proceeds of assessments collected and/or bonds sold, but the amount subject to adjustment until completion of construction;
