(i) Total Units Applied For Does Not Exceed The <br />Yearly Allocation For Smaller Projects - In the event <br />the total units contained in all the projects making <br />application during the one week initial application <br />period does not exceed the total yearly allocation for <br />smaller projects, all the projects which have applied <br />shall be granted development approval and subsequent <br />projects making application shall be approved~on a <br />first come, first served basis until the total yearly <br />allocation for smaller projects has been exhausted. <br /> <br /> (ii) Total Units Applied For Exceed The Yearly <br />Allocation For Smaller Projects In the event the <br />total units contained in all the projects making <br />application during the one week initial application <br />period exceed the total yearly allocation for smaller <br />projects, the City Council shall decide at the soonest <br />regularly scheduled meeting for which proper notice can <br />be given the manner in which development approval shall <br />be given. The City Council, in its discretion, shall <br />select projects by lot, by apportioning approval on a <br />pro rata basis, or by any other manner deemed appropriate <br />by the City Council. The City Council shall give <br />project applicants the opportunity to be heard concerning <br />the manner development approval shall be given prior to <br />making its decision and granting development approval. <br /> <br /> (iii) Procedures If The Yearly Allocation Is <br />Made By Categories - If the City Council has allocated <br />units by categories (eg. single-family or multiple), <br />projects within each category shall be treated separately, <br />with the allocation set for each category being the <br />"yearly allocation" described above. <br /> <br /> (iv) Other Procedures In the event approval of <br />a project as applied (using any of the methods possible <br />for selecting projects) would exceed, in combination <br />with prior projects approved, the total yearly allocation <br />for smaller projects (or category allocations), the <br />entire project as submitted shall be approved. <br /> <br />Projects not selected must reapply for subsequent <br />yearly allocations for smaller projects. No priority <br />list will carry over to a subsequent allocation period, <br />whether a project has received development approval for <br />a portion of its units or whether a project applied but <br />received no approval. <br /> <br /> (e) Other Requirements of Projects Selected - Every project <br />receiving development approval as part of the smaller project <br />allocation process shall meet the following requirements: <br /> <br /><i) <br /> <br />$525 per dwelling unit fee to the Capital <br />Improvement Fund. <br /> <br />III <br /> <br />(ii) <br /> <br />$400 per dwelling unit fee to the Lower-Income <br />Housing Fund. <br /> <br /> -6- <br /> <br /> <br />
