may approve lower-income projects up to the number of <br />units in the set-aside and may include anticipated <br />future allocations. A project containing both lower- <br />income units and market rate units shall be approved in <br />its entirety. Only lower-income units shall count <br />toward the lower-income set-aside. The ten percent <br />allocation shall carry-over from year to year. <br /> <br />meet <br /> <br />(b) Other Requirements of Exempt Projects. <br />In order to develop, exempt projects are required to <br />the following requirements: <br /> <br /> (i) $525 per dwelling unit fee to the Capital <br />Improvement Fund. <br /> <br /> (ii) $400 per dwelling unit fee to the Lower- <br />Income Housing Fund. <br /> <br />Section 2. Long-Term Agreements. <br /> <br /> (a) Eligibility - Eligible projects shall be those <br />meeting the criteria contained in Section 2-20.05 of Chapter <br />13, Title II of the Ordinance Code of the City of Pleasanton. <br />Governmental approvals necessary would normally be those <br />listed in Section 2-20.05(b)(2) of Chapter 13. However, <br />certain large projects, especially PUD's, may apply without <br />finally delineating all aspects of the project. For example, <br />a first phase covering one or more years may be shown with <br />subsequent phases only tentatively indicated as to street <br />patterns, densities, uses, etc. The City Council, in its <br />discretion, may choose to enter an agreement based on such a <br />plan if it feels sufficient information exists for it to <br />enter such an agreement. A developer shall have to submit <br />sufficient information, or shall have to have received <br />sufficient prior governmental approvals, for the City Council <br />to make the determinations necessary for reaching agreement <br />on a long-term development approval. <br /> <br /> (b) Application Procedure - Application shall be <br />submitted on a form devised by and containing information <br />required by the Director of Planning and Community Development. <br />Applications may be submitted at any time. Additional <br />information may be required by the City Council during <br />negotiations. <br /> <br /> Initially, however, the City Council may use the following <br />procedure. The City Council may attempt to determine the <br />interest in long-term agreements among those eligible in <br />relation to potential smaller project applications and <br />allowable growth rates prior to entering into an agreement <br />with any developer.
