February 23, <br /> <br /> EXHIBIT "A" <br /> <br />GROWTH MANAGEMENT PROCEDURES AND GUIDELINES <br /> <br />1982 <br /> <br />Section 1o Exempt Projects <br /> <br /> (a) Eligibility and A proval Procedures. <br /> Exempt projects shall ~e those enumerated in §2-20.04 <br />of Chapter 13, Title II of the Ordinance Code (Growth Management <br />Program). All project approvals and permit regulations <br />shall apply to exempt projects except the development approval <br />procedures contained in Chapter 13. Exempt projects may <br />develop at any time during the year with no limitation on <br />total numbers of units nor project size, except as indicated <br />below. <br /> <br /> (i) Projects Participating in ~rtgage Revenue <br />Bond Program - Development shall be in accordance with <br />the terms and conditions of the agreement entered into <br />by the developer and the City. The Mortgage Revenue <br />Bond Program is that program authorized by AB 1355. <br /> <br /> (ii) Projects Selected Through the Affordable <br />Housing Competition - The affordable housing competition <br />shall be that program, or series of programs, authorized <br />by the City Council by Resolution No. 81-287 to provide <br />an incentive for developers to construct such housing. <br />Once selected, the project(s) would be exempt from the <br />Growth Management development approval process. <br /> <br /> (iii) Lower-Income Housing Developments - Lower- <br />income housing projects are those sponsored by any <br />person or organization having a minimum of twenty-five <br />percent (25%) of its units reserved for households <br />qualifying for federal lower income housing assistance <br />as defined by HUD for the Bay Area region. Units must <br />be reserved for lower-income households for a period of <br />at least 25 years. HUD regulations concerning household <br />income, percentage of income eligible for housing costs, <br />size of unit in relation to household size, etc. shall <br />be those in effect at the time the project applies <br />for exemption. (For instance, the present HUD regulations <br />require households qualifying for lower-income housing <br />assistance to have incomes no more than eighty percent <br />(80%) of the Bay Area median for that specific household <br />size. Housing cost (either through rental or purchase) <br />may not exceed 25 percent (25%) of a household's gross <br />monthly income.) Projects meeting the above criteria <br />are eligible to request exemption from the Growth <br />Management development approval process and to use the <br />units set aside for such projects.
