that the approved unit prices shall be the maximum price to be <br />applied in calculating the cost of acquisition of improvements; <br /> <br /> 3. That the described improvements shall be certified <br /> <br />by the Director of Public Works as complete and ready for acceptance <br />before the initiation of special assessment proceedings; <br /> <br /> 4. That the developer shall submit evidence satisfactory <br />to this Council that the costs proposed to be assessed shall have been <br />actually incurred and paid; and that the developer shall submit a <br />conformed copy of the notice of completion and a title report} prior <br />to confirmation of the assessment, as evidence that no stop notice <br />had been filed within the period allowed by law. <br /> <br /> This resolution shall in no way constitute a guarantee <br /> <br />or assurance Chat the special assessment proceedings will be completed, <br />the City Council being without jurisdiction to assure the levy of <br />special assessments until conducting a public hearing as required <br />by the Municipal Improvement Act of 1913. <br /> <br /> I HEREBY CERTIFY that the foregoing resolution was duly <br />and regularly adopted by the City Council of the City of Pleasanton, <br />Alameda County, California, at a regular meeting thereof, held on <br />the 23rd day of February , 1982. <br /> <br /> Councilmembers Butler, Kephart, Mohr, Wood and Mayor Mercer <br /> <br />Councilmembers <br />Councilmembers <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />None <br /> <br />None <br /> <br /> JAMES R.
