WHEREAS, <br /> <br />WHEREAS , <br /> <br />WHEREAS, <br /> <br />WIIEREAS, <br /> <br />WIIEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAF~DA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-106 <br /> <br />RESOLUTION APPROVING A CONSTRUCTION AND MAINTENANCE <br />AGREEmeNT WITH ALAMEDA COUNTY, THE SOUTHERN PACIFIC <br />TRANSPORTATION COMPANY AND THE WESTERN PACIFIC <br />P~ILROAD COMPANY FOR THE CONSTRUCTION OF THE <br />NILES-PLEASANTON TRACK CONSOLIDATION PROJECT <br /> <br />the City of Pleasanton, County of Alameda, Southern <br />Pacific Transportation Company, and The Western <br />Pacific Railroad Company propose to cooperate in <br />the construction and maintenance of a comprehensive <br />grade separation and grade crossing elimination <br />project, designated herein as the Niles-Pleasanton <br />Track Consolidation Project, which would include <br />construction of underpasses at the point of inter- <br />section of the realigned Bernal Avenue and Del <br />Valle Parkway with the right-of-way of the Western <br />Pacific Railroad, construction of a new street <br />connecting between St. Mary's Street and Rose <br />AvenUe, to allow closing of the Division Street <br />grade crossing, and the elimination of the Southern <br />Pacific Railroad trackage within the City of <br />Pleasanton; and <br /> <br />the Western Pacific Railroad Company and the <br />Southern Pacific Transportation Company have <br />negotiated a joint trackage agreement enabling the <br />aforementioned consolidation to take place; and <br /> <br />the City of Pleasanton and Alameda County are <br />seeking financial assistance from the State of <br />California pursuant to Section 190 of the Streets <br />and Highways Code; and <br /> <br />the consolidation project was established as No. 5 <br />on the priority list of the Public Utilities <br />Commission, making it eligible for State financial <br />assistance; and <br /> <br />Section 190 of the Streets and Highways Code <br />requires that local agencies requesting an allocation <br />of State funds to assist in the financing of the <br />construction of grade separation projects enter <br />into an agreement with the affected railroad or <br />railroads for the maintenance and construction of <br />grade separation; <br /> <br /> <br />
