WHEREAS, WHEREAS , WHEREAS, WIIEREAS, WIIEREAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAF~DA COUNTY, CALIFORNIA RESOLUTION NO. 82-106 RESOLUTION APPROVING A CONSTRUCTION AND MAINTENANCE AGREEmeNT WITH ALAMEDA COUNTY, THE SOUTHERN PACIFIC TRANSPORTATION COMPANY AND THE WESTERN PACIFIC P~ILROAD COMPANY FOR THE CONSTRUCTION OF THE NILES-PLEASANTON TRACK CONSOLIDATION PROJECT the City of Pleasanton, County of Alameda, Southern Pacific Transportation Company, and The Western Pacific Railroad Company propose to cooperate in the construction and maintenance of a comprehensive grade separation and grade crossing elimination project, designated herein as the Niles-Pleasanton Track Consolidation Project, which would include construction of underpasses at the point of inter- section of the realigned Bernal Avenue and Del Valle Parkway with the right-of-way of the Western Pacific Railroad, construction of a new street connecting between St. Mary's Street and Rose AvenUe, to allow closing of the Division Street grade crossing, and the elimination of the Southern Pacific Railroad trackage within the City of Pleasanton; and the Western Pacific Railroad Company and the Southern Pacific Transportation Company have negotiated a joint trackage agreement enabling the aforementioned consolidation to take place; and the City of Pleasanton and Alameda County are seeking financial assistance from the State of California pursuant to Section 190 of the Streets and Highways Code; and the consolidation project was established as No. 5 on the priority list of the Public Utilities Commission, making it eligible for State financial assistance; and Section 190 of the Streets and Highways Code requires that local agencies requesting an allocation of State funds to assist in the financing of the construction of grade separation projects enter into an agreement with the affected railroad or railroads for the maintenance and construction of grade separation;
