Section 22. Resignation, Reinstatement and Layoff <br /> <br />22.1 <br /> <br />Automatic Resignation <br /> <br />Failure to return at the expiration of a leave of absence <br />or being absent without leave shall be considered an auto- <br />matic resignation. Such a resignation may be rescinded <br />by the City Manager if the employee submits satisfactory <br />reasons for his/her absence within three days of the date <br />his/her resignation was effected. <br /> <br />22.2 <br /> <br />Voluntary Resignation <br /> <br />An employee may resign in good standing by submitting to <br />the Personnel Officer a written resignation stating the <br />reasons therefor and effective date thereof at least <br />two (2) weeks prior thereto. <br /> <br />A statement as to the resigned employee's performance <br />shall be forwarded to the Personnel Officer by the <br />Department Head. <br /> <br />22.3 <br /> <br />Reinstatement <br /> <br />With the approval of the Personnel Officer, a permanent <br />or probationary employee who has resigned in good standing <br />may be reinstated within two (2) years, of the effective <br />date of resignation, to a vacant position in the same or <br />comparable class. Upon reinstatement, the employee, <br />for all purposes, shall be considered as though he/she <br />had received a new appointment. <br /> <br />22.4 Layoff <br /> <br />The Appointing Authority may lay off an employee in the <br />competitive service because of material changes in duties, <br />organization or shortage of work or funds. The employee <br />shall be notified of such action in writing together with <br />reasons therefor. <br /> <br />22.5 <br /> <br />Order of Layoff <br /> <br />Layoffs shall be by position classification within a <br />division. In effecting layoffs, employees with the least <br />length of service in the classifications affected shall <br />be laid off first. <br /> <br />-33- <br /> <br /> <br />
