If the property is under 30 acres, specific <br />conditions will be included in the contract <br />to prohibit subsequent construction of a <br />single family residence if the property does <br />not qualify for such use under II.B.2. <br /> <br />All properties whose inclusion in the program <br />is conditioned upon intensive commercial <br />agricultural use will be subject to bienneal <br />review. In June of each even numbered year, <br />the Planning Department shall contact the <br />owners of such property for a statement to <br />include specific uses, income figures, and <br />any other pertinent information. Based on <br />this information, the Planning Department <br />shall make recommendations to the City Council <br />as to whether that contract should be renewed <br />or non-renewed. <br /> <br />Establishment, Modification, and Disestablishment <br />Procedures <br /> <br />An action to establish, modify, or disestablish <br />an agricultural preserve may be initiated by <br />the City Council or any property owner or <br />olNIlers. <br /> <br />Landowner applications shall be filed with <br />the Planning Department and must be signed by <br />all property owners seeking inclusion in the <br />proposed preserve area. The application <br />shall be made on a form prepared by the <br />Planning Department and shall include, at a <br />minimum, a legal description of the property <br />or properties or the assessor's parcel number <br />or numbers; the land owner or owners of each <br />parcel; location and size of each parcel; the <br />current use of the property; and the types of <br />structures and their use located on each <br />parcel. Additional information, maps, or <br />other materials may be required as necessary. <br /> <br />Within 30 days of receipt of an application, <br />or City Council initiated action, the Planning <br />Department shall submit a report and recommendation <br />to the City Council, provided, however, that <br />the City Council may authorize an additional <br />30 day period. The report shall include a <br />statement that the preserve would be consistent, <br />or inconsistent, with the General Plan, and <br />the City Council shall make a finding to such <br />effect following a public hearing on the <br />proposal. <br /> <br />-3- <br /> <br /> <br />
